1. What is this Document?

1.1. These terms of use, read together with the Privacy Policy, constitutes a legal and binding contract (the "Agreement") between you and Ask Techsoft Care Private Limited (ATCPL), a company existing under the laws of India providing, inter alia, the terms that govern your access to use (i) ATCPL website www.drsafehands.com (ii) ATCPL mobile applications, (iii) ATCPL online healthcare solutions, which inter alia facilitates the interaction between healthcare providers including, but not restricted to, healthcare practitioners such as doctors, diagnostic centres etc. (collectively referred to as the "HealthcareProviders") and recipients (the "HealthcareRecipients") (collectively referred to as "Users"), and (v) any other service that may be provided by ATCPL from time to time (collectively referred to as the "Services").

You hereby agree and understand that this Agreement is a binding contract between ATCPL and anyone who accesses, browses, or uses the Services in any manner. If you do not agree, you shall not use the Services. The use of the Services would constitute acceptance of the terms of this Agreement.

2. Terms and Conditions Applicable to Users

2.1. Users must be 18 (eighteen) years of age or older to use the Services.

2.2. This Agreement is governed by Indian law, including:

  • Indian Contract Act, 1872
  • Information Technology Act, 2000
  • Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Information) Rules, 2011
  • Information Technology (Intermediaries Guidelines) Rules, 2011

2.3. All content on the platform including text, graphics, images, logos, and software is the property of ATCPL and protected under applicable laws.

2.4. ATCPL shall not be liable for transactions between you and third parties.

2.5. Users may receive communications such as SMS, notifications, and reminders related to services and appointments.

2.6. ATCPL may update or modify services or this Agreement at any time without prior notice.

2.7. ATCPL is not liable for interruptions in service.

2.8. Use of services is governed by the Privacy Policy.

2.9. Certain clauses apply specifically to Healthcare Recipients and Providers.

3. Terms and Conditions Applicable to Healthcare Recipients

3.1. Registration

  • Users must register with details such as name, age, email, and phone number.
  • Registration is one-time and credentials must be kept confidential.

3.2. Communication with Healthcare Providers

  • Users may communicate with providers for basic consultation and appointments.
  • Sensitive medical data may be shared at user discretion.

3.3. Services are for identifying providers, scheduling appointments, and accessing reports. Not for emergencies.

3.4. Information provided does not constitute medical advice or doctor-patient relationship.

3.5. ATCPL is not liable for:

  • Incorrect treatment or prescriptions
  • Missed appointments
  • Misconduct by providers
  • Appointment changes
  • Incorrect diagnosis
  • Fee variations
  • Health complications

3.6. ATCPL does not guarantee accuracy of provider details.

4. Terms and Conditions Applicable to Healthcare Providers

  • Registration requires professional and personal details
  • ATCPL may moderate communication
  • User feedback and ratings may be displayed
  • Platform only facilitates connections, no guarantees
  • Providers must comply with applicable laws

5. User Covenants

Users must not post or share content that:

  • Belongs to another person
  • Is harmful, abusive, defamatory, obscene, or illegal
  • Harms minors
  • Violates intellectual property
  • Misleads or impersonates others
  • Contains malware or harmful code

Users must not:

  • Violate platform security
  • Submit false information
  • Use bots or scraping tools
  • Reverse engineer the platform
  • Copy platform content

6. Third Party Information

ATCPL is not responsible for third-party information and users access it at their own risk.

7. Intellectual Property Rights

All intellectual property belongs to ATCPL or respective owners and cannot be reused without permission.

8. Unlawful or Prohibited Use

Users must comply with all applicable laws while using the platform.

9. Liability

ATCPL is not responsible for services provided by healthcare providers.

Maximum liability is limited to INR 1,000.

10. Indemnity

Users agree to indemnify ATCPL against any claims arising from misuse of services.

12. Severability

If any provision is invalid, remaining provisions remain enforceable.

13. Term and Termination

Agreement remains valid while using services. ATCPL may terminate access for violations.
